What Happens When You Die Without a Will
When an individual dies without a Will (intestate), assets are distributed according to religious personal succession laws (e.g., Hindu Succession Act, Indian Succession Act).
This frequently leads to bank accounts being frozen, demanding legal heir certificates, succession certificates, and expensive court litigation that takes 3–7 years.
The 5 Rules of a Watertight Will in India:
1. Plain Language: You do not need complex legal jargon. A clear statement of "I leave my 50% share in Flat 402 to my daughter Priya" is fully valid.
2. Sound Mind Declaration: Include a certificate from a registered medical practitioner confirming sound mental health at the time of signing.
3. Two Independent Witnesses: Witnesses must sign in your physical presence (they should not be direct beneficiaries under the Will).
4. Appoint a Reliable Executor: Name a trusted person who will oversee the asset distribution.
5. Registration at Sub-Registrar Office: While unregistered Wills are legally valid, registering your Will at the local sub-registrar's office eliminates future disputes over authenticity.
