Every March, HR emails asking you to lock in a regime. Most people just guess. This guide, plus our calculator, gives you the real answer in two minutes.

Every year in March, HR sends the email — "please confirm your regime." Most people just tick "new" because it feels simpler. Some stay on "old" because a parent said 80C is important. Both are sometimes wrong. Let's look at the actual FY 2025-26 numbers.

The new regime — after the Feb 2025 budget

The rebate now goes up to ₹12 lakh. Standard deduction is ₹75,000. The slabs:

  • ₹0–4L — 0%
  • ₹4L–8L — 5%
  • ₹8L–12L — 10%
  • ₹12L–16L — 15%
  • ₹16L–20L — 20%
  • ₹20L–24L — 25%
  • ₹24L+ — 30%

The rebate story: if your taxable income is ₹12L or lower, you owe zero tax. Add the standard deduction and salaries up to ₹12.75L pay nothing — without needing any 80C, HRA or mediclaim maneuvering.

The new regime, in one line: "no deduction paperwork, straight to the slab."

The old regime — where deductions pay off

The slabs are almost the same, but every trick is allowed:

  • 80C — ₹1.5L (PPF, ELSS, LIC, EPF, home loan principal)
  • 80D — ₹25k for self, ₹50k for senior parents
  • HRA — depends on city and rent
  • Home loan interest — ₹2L for self-occupied
  • NPS 80CCD(1B) — extra ₹50k
  • LTA, food coupons and more

So who wins?

A rough rule:

  • Total deductions under ~₹4-5 lakh — new regime almost always wins.
  • Deductions around ~₹5.5-7 lakh — very close. Use a calculator.
  • Claiming HRA + home loan + full 80C + mediclaim together — old regime can save lakhs.

Two case studies

Priya, 27, Bangalore, ₹15L salary. No home loan, ₹1.5L PPF, ₹25k mediclaim. Total deductions ~₹1.75L plus standard. In the old regime, taxable ~₹12.75L. In the new regime the rebate is used up by the time you cross ₹12L, taxable ~₹14.25L. Even then, the new regime still saves ~₹40-50k a year here.

Ravi, 38, Mumbai, ₹28L salary. Home loan interest ₹2L, HRA exemption ₹4L, 80C ₹1.5L, 80D ₹75k (senior parents). Total deductions ~₹8L plus standard. The old regime saves ~₹1-1.5L a year here.

Every case is different. Put your actual numbers into our tax calculator — you'll know in 30 seconds.

The one-line answer

Middle income with few deductions → new. High income with home loan + HRA + full 80C → old. Somewhere in the middle? Open the calculator. Don't forward emails to HR.
